These Terms of Service (“Terms”) govern your access to and use of svgapp.ai and related services (collectively, the “Service”). By using the Service, you agree to these Terms. If you use the Service on behalf of an entity, you represent that you have authority to bind that entity, and “you” refers to that entity.
1) What the Service Does
svgapp.ai lets you:
- generate images from text or images using third-party AI models (currently via fal.ai); and
- vectorize images (currently via vectorizer.ai).
The frontend is served via Cloudflare and the backend runs on Convex Cloud. Third-party providers are processors acting on our instructions. Details are in our Privacy Policy.
2) Eligibility & Accounts
- You must be at least 16 years old (or the minimum age of digital consent in your country) to use the Service.
- If registration is offered, you must provide accurate information and keep your credentials confidential. You are responsible for activities under your account.
3) Your Content; Permissions You Give Us
Definitions. “Inputs” means any prompts, text, images, files, settings, or other material you submit to the Service. “Outputs” means any content the Service generates for you (e.g., raster images, vectors). “Your Content” collectively means Inputs and Outputs, plus your account/profile information.
Ownership (Inputs). You retain all rights you hold in Your Content.
License to operate the Service. You grant us and our subprocessors a non-exclusive, worldwide, royalty-free license to host, cache, transmit, process, store, and display Your Content solely to provide, maintain, secure, and support the Service (including temporary copies, backups, debugging, and abuse prevention). This license lasts for the period necessary to deliver the Service and for any legally required or operational retention described in the Privacy Policy.
Ownership (Outputs). As between you and us, and to the fullest extent permitted by law, we assign to you any intellectual property rights we may have in the Outputs. Where assignment is not possible, we grant you an exclusive, perpetual, irrevocable, worldwide, transferable, sublicensable, royalty-free license to use, reproduce, modify, and distribute Outputs for any lawful purpose.
Model improvement We may use Your Content for training, fine-tuning, evaluating, or otherwise improving models:
- You grant us and our subprocessors a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, analyze, modify, create derivative works from, and combine Your Content with other data for the purposes of training, fine-tuning, evaluating, and improving our models and quality/safety systems, including associated activities such as labeling, human review (under confidentiality), and benchmarking.
- We will use proportionate technical and organizational measures to minimize personal data in training corpora (e.g., filtering and de-identification), while recognizing that complete anonymization cannot be guaranteed.
Service metadata and de-identified data. Independently of the opt-in above, we may process service metadata (e.g., aggregated usage statistics, performance metrics, error logs) and de-identified data derived from Your Content to ensure security, abuse prevention, reliability, and service analytics, as described in the Privacy Policy.
Public sharing. If you intentionally publish or share Outputs or Inputs publicly through the Service (e.g., galleries, community posts), you grant us a non-exclusive, worldwide, royalty-free license to host and display that publicly shared material for the purpose you selected (e.g., showcasing your work within the Service), which you can revoke by deleting the public post.
No exclusivity vs. others. Generative systems may produce similar results for different users. We do not guarantee that Outputs are unique to you.
Third-party rights and lawful basis. You are responsible for ensuring that your Inputs and use of Outputs comply with applicable law and do not infringe third-party rights (e.g., copyright, trademarks, personality/privacy rights). Do not upload personal data of others without a lawful basis and, where required, their valid consent.
4) Acceptable Use
You must not use the Service to:
- violate laws or rights (including copyright, trademark, privacy, personality rights);
- upload or generate unlawful, harmful, defamatory, hateful, harassing, or sexually exploitative content;
- create or disseminate deceptive or non-consensual deepfakes;
- attempt to reverse engineer, probe, or disrupt the Service or underlying models;
- circumvent usage limits, security, or rate controls;
- upload personal data of others without a lawful basis and necessary permissions/consent.
We may suspend or terminate access for violations (see Section 11).
5) Third-Party Services & Terms
The Service integrates third-party services (including fal.ai, vectorizer.ai, Cloudflare, Convex). Your use is also subject to their standard terms and policies. We are not responsible for their acts or omissions. Where third-party terms require it, you agree to comply with those terms to the extent they apply to your use of the Service.
6) Plans, Fees, and Taxes (if applicable)
- Billing & Renewal. Subscriptions renew automatically unless cancelled as described at the point of sale.
- Prices/Changes. We may change prices with reasonable advance notice for the next term.
- Taxes. Prices may exclude applicable taxes; you are responsible for them.
- Refunds. Statutory consumer rights apply (see Section 9). Otherwise, fees are non-refundable once the term begins unless we state otherwise.
7) Intellectual Property; Feedback
- The Service (including software, models, and website content) is protected by IP laws and licensed or owned by us or our licensors. No rights are granted except as expressly stated.
- If you send feedback or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them without obligation to you.
8) Data Protection & Security
Processing of personal data is described in our Privacy Policy, which forms part of these Terms. We implement appropriate technical and organizational measures designed to protect personal data and service data. No method of transmission or storage is perfectly secure; you use the Service at your own risk.
9) Consumers in the EU/EEA (Widerrufsrecht)
If you are a consumer:
- Right of withdrawal: For paid digital services purchased remotely, you generally have 14 days to withdraw without giving reasons.
- Loss of withdrawal right: If you request immediate performance and acknowledge that you thereby lose your withdrawal right once performance starts, we may start the service immediately, and the withdrawal right no longer applies after service begins.
- How to withdraw: Send a clear statement (email is sufficient) to felix@xz3.dev within 14 days of purchase. If applicable, we will refund payments per law, using the same payment method, less any value for services already provided at your request before withdrawal.
We are neither willing nor obliged to participate in dispute resolution before a consumer arbitration board. The EU ODR platform is available for consumers at https://ec.europa.eu/consumers/odr.
10) Warranties & Disclaimers
THE SERVICE AND OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” To the extent permitted by law, we and our suppliers disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that Outputs will be accurate, free of third-party rights, or suitable for a particular use.
- You are solely responsible for reviewing Outputs for legal compliance and accuracy before any reliance, publication, commercialization, or distribution.
11) Limitation of Liability
To the extent permitted by law:
- Indirect damages excluded. We are not liable for lost profits, lost data, or indirect/consequential damages.
- Cap. Our aggregate liability for all claims relating to the Service is limited to the greater of (a) EUR 50 and (b) the amounts you paid to us for the Service in the 12 months before the claim.
- Consumer protection. This Section does not limit liability for gross negligence, willful misconduct, injury to life/body/health, or where liability cannot be limited under applicable law.
12) Infringement Notices (Copyright/Personality Rights)
If you believe the Service hosts or generated material that infringes your rights, send a notice to felix@xz3.dev with:
- your contact details;
- identification of the work/rights claimed;
- the exact location/description of the content;
- a statement of good-faith belief that the use is not authorized; and
- a statement that the information is accurate and, under penalty of perjury (or equivalent under applicable law), that you are authorized to act.
We may request additional information and may remove or disable access to contested material in our discretion.
13) Service Changes; Availability; Beta
We may modify or discontinue features (including integrations) with reasonable notice where feasible. The Service may occasionally be unavailable due to maintenance or issues beyond our control. Features marked as alpha/beta/preview are provided for testing “as is” and may be withdrawn.
14) Suspension & Termination
You may stop using the Service at any time. We may suspend or terminate access immediately if:
- you materially breach these Terms or applicable laws;
- your use creates risk or potential liability for us or others; or
- required by law or third-party providers.
Upon termination, Sections that by nature should survive (e.g., 3, 7–12, 15–16) will survive.
15) Governing Law; Venue; Consumers’ Mandatory Rights
These Terms are governed by the laws of Germany, excluding its conflict-of-law rules.
- For merchants and public law entities, exclusive venue is Hanover (Niedersachsen), Germany.
- If you are a consumer, you may bring claims in your country of residence under mandatory consumer protection laws; nothing in these Terms limits such rights.
16) Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
- Severability. If a provision is unenforceable, the remainder remains in effect; the unenforceable provision shall be replaced by a valid one closest to the original intent.
- No waiver. A failure to enforce is not a waiver.
- Assignment. You may not assign these Terms without our prior written consent; we may assign in connection with a merger, acquisition, or sale of assets.
- Notices. We may notify you via the Service, email, or the address you provide.
- Language. The controlling language of these Terms is English; translations (if any) are for convenience only.
